According to federal law, anyone to whom you owe money may obtain a judgment against you and use it to garnish up to 25 percent of your disposable income. Disposable income is income remaining after the withholding of taxes and other required deductions, such as insurance.

In addition, creditors, collectors and anyone else to whom you owe money may obtain a bank garnishment to have money frozen, or seized outright, from your bank account. Typically, when bank accounts are garnished, the debtor is caught by surprise. Collectors notify the bank first. Your funds are frozen before you know it or have time to withdraw the money from your account.

Garnishment is a Nightmare
Garnishment is a real nightmare for many of the people we see. And all too often, garnishment is only one of their problems. They are also having nightmares about repossession or seizure of their property by creditors, and crippling interest rates on their credit card debt. Perhaps they bought luxury items on credit when their financial outlook was brighter, and now, due to a cut in pay or being laid off, they are saddled with debt they can no longer afford.

Most wage garnishments can be stopped and creditor judgments can be discharged through Chapter 7 or Chapter 13 bankruptcy. However, some garnishments cannot be stopped, such as child support and alimony.
